Something which is puzzling me- for Jude or Jane?

I haven't had much chance to post over the last couple of weeks but have been doing a lot of thinking about things and had a bit of a nosey around at various things today which to be honest only threw up yet more questions. One of the thoughts I've had lately is that I should really read up on the legislation regarding setting up in soap making and the the assesments required etc.

Before I ask this, I just want to make it absolutely clear that I have no intention whatsoever of setting up selling kits but it's got me thinking...

Say I was selling kits to make soap or bath bombs (as Jude does) which contain ingedients I can buy over the counter so to speak, do these still need to be assessed if you're selling them to the public as a kit as opposed to a finished product and if so, why?

I'm getting the feeling of dajavou (or however you spell it lol)

I asked this same question to Judi around a week ago, now I'm going to leave it up to them to answer as Judi may not want me repeating what she told me :)

Okay thanks Shane...hmmm, I never seen that thread/posts or else I'd not have asked it again. Can you remember what thread it was in and what it was called?

There are many puzzling questions/answers surrounding the selling/making of soaps and cosmaceuticals !

My stock answer to all questions is to ask your local TSD - even they differ from county to county.

My TDS - may give differing answers to Judi's.

That's yet another thing which puzzles me lol...why do TS branches differ in their opinions so much. Surely national legislation should be just that and not open to the interpretation of each individual TS branch? What a minefield huh!

Interpretation my dear - EU directives are interpreted differently by each member state, most EU countries treat them as directives - UK treat them as law - filtered down to each county interpreting them differently.

For example - I can make soap in the UK fully EU comliant - but I could not make soap in France to sell - crazy?

It is the same in most industries.

Another thought then...

What would happen if say Judith's local TS said she doesn't to have a license for her kits but she employed me to make and dispatch them and my local TS said a license WAS required or vice versa?

Sorry Judith, juts using you as an example here as you're the only other soap maker I can think of on here who makes and then sells your products to the public.

All I can say is that we contact each TSD - 8 in total - we have to - to trade on the Farmers Markets - that we do - should there be a problem with the 9th TDS we would refer them to the other - 8

Exactly! The UK as a whole is a member state, not individual counties and if the UK treats the EU directives as law then the law should apply evenly in every county. It's dafter than daft isn't it- a bit like saying fraud is only a felony in London and Merseyside but not in any other county lol!
